Delhi Water Minister Kapil Mishra launched a scathing attack on the collusion between the LG and illegally appointed ACB Chief MK Meena along with Congress’ Sheila Dikshit to save her from investigations and FIRs on her corruption as the former Chief Minister Minister of Delhi. His statement is given below:
4 FIRs were registered against Sheila Dikshit 2 years and 5 months ago. There has been no action on those FIRs till date. I have written a recommendation letter demanding the arrest of Lieutenant Governor Najeeb Jung and the illegally appointed ACB Chief MK Meena using their own “standards”. They have sought to arrest CM Arvind Kejriwal and me who are the complainants and investigators of corruption, while not even thinking about the accused. This is done on the sole basis of saying that we delayed the report. The LG Najeeb Jung and the ACB have been sitting on 4 FIRs and investigative reports for 2 years and 5 months. This is a disgrace and more importantly an illegality that necessitates an immediate FIR against them.
Yesterday, a “notice” was sent to former CM Sheila Dikshit ji on one of the FIRs filed by the 49 day AAP Delhi Government, which is the water meter procurement scam. It was more of a request letter than a notice.
2 years and 5 months after the FIR is filed, the ACB has sent the accused, former Congress CM Sheila Dikshit stating “A suitable and convenient date, time and place are required to be fixed for above mentioned purpose in the month of August 2016. The same may be conveyed to the undersigned at the earliest.”
The request letter in the form of a “notice” also doesn’t mention any section of India’s Criminal Procedure Code as is mandated on any notice served.
This is the attitude of the LG and ACB towards someone who, at the very least, based on evidence, is accused of 5 major charges and scams of corruption. After 2 years and 5 months of sitting on the FIRs and evidence.
At the same time, as a complainant, I had received a notice under Section 160 of the CrPC and was ordered to report an exact address, date, time and venue to appear in front of an ACB Investigative Officer. After just 10 days of a plain paper complaint made by Vijendar Gupta.
The LG and ACB are fast and efficient to send notices and file FIRs against CM Arvind Kejriwal ji and me. However, they are extremely polite and nice to former CM Sheila Dikshit.
The way ACB is treating former CM Sheila Dikshit, it seems crystal clear that she is CHACHI of PM Narendra Modi. Why is her permission for a meeting with an investigation agency being sought with such honour and joy like a festival is being celebrated? Did the illegally appointed ACB Chief MK Meena send a box of sweets and fruits along with this request?
Three things are very clear:
1. The BJP is trying to use the LG and ACB to give former CM Sheila Dikshit a clean chit.
2. The LG and ACB have been ordered to implicate the complainant and anti-corruption crusaders of the AAP Delhi Government.
3. There is no law for Sheila Dikshit ji since this illegal notice doesn’t even pressure or require her to file a reply or a time to meet the ACB.
In the history of Indian polity, there has never been more disregard to the rule of law and order. The illegally appointed ACB Chief MK Meena should resign on moral or ethical grounds for either not knowing the Constitution or for actively colluding as a caged parrot to save the former CM Sheila Dikshit.
Now, I want to expose the facts behind this scam, one of five, in which Sheila Dikshit ji is directly implicated. That of the procurement of non-AMR meters during her tenure as the CM and Chairperson of the Delhi Jal Board. I will expose each and every case as the days progress in order to bring to the public how the BJP and Congress are colluding to save each other.
The DJB was procuring 2.5 lakh non-AMR meters for which bids were invited. In severe violation of vigilance norms , despite there being only a single bid from a company, the work was awarded to that company, and that too, when they had bid only for 1.5 lakh water meters. The work was awarded for 2.5 lakh meters without following processes or rules, with an extra order of 1 lakh extra meters in subsequent meters. The involvement of the former CM Sheila Dikshit in this process is clearly mentioned in every meeting of hers at the DJB.
Further, the price that was quoted was Rs. 2600, which was then negotiated down to Rs. 1918. However, in complete violation of the agreement’s Clause number 8.2.1 of the tender. Clause number 8.2.1 clearly shows that the quoted meter price was an a price inclusive of all costs inclusive of insurance, levies, taxes, overheads and other logistical costs. However, the Congress Government added the VAT and Labour Cost over the price of Rs. 1918.
Attached to the report were 5 bills of procurement of meters from the open market for Rs. 875-Rs. 1075 with their bills attached. The DJB paid needlessly a price that was more than double the on-ground open market cost.
This has led to a loss of Rs. 33 crores to the exchequer, directly created a loss for the common man. This is just one of the five huge corruption scandals, which have been exposed by the AAP Government.
In this background, I want to ask the LG Najeeb Jung and his illegally appointed ACB Chief MK Meena a few questions:
1. Under whose pressure are you working to exonerate former CM Sheila Dikshit?
2. Who is trying to get you to work in direct contravention of the law of the land? Why are you treating the complainant with harshness and the accused like a family member?
3. Why has there been a delay of 2 years and 5 months to issue one request letter on 5 matters to former CM Sheila Dikshit, while at the same time you issue notices to the AAP Delhi Government in less than 10 days despite them being the anti-corruption crusaders?
4. What action have you taken against the former CM Sheila Dikshit in 2 years and 5 months? How many notices and investigative enquiries have you conducted?
I want to ask the opposition (Bharatiya Janata Party) 5 serious questions that this nation wants to know:
1. Who is the senior BJP leader who is hosting meetings on the Tanker Scam at his home to ensure that Sheila Dikshit ji is not arrested or even named by BJP leaders?
2. Who is the senior BJP leader who is asking the ACB and LG to only implicate the names of Arvind Kejriwal and Kapil Mishra for being the complainants against financial corruption?
3. Very simply, do you or do you not believe that the former CM Sheila Dikshit be arrested for her role in these 5 major corruption scandals? If yes, who is stopping you from doing so?
4. The former CM Sheila Dikshit has on numerous occasions mentioned that all these decisions were taken along with members of the BJP. Who are these members?
5. 5 FIRs and investigative reports with evidence and facts are lying with the ACB. Why is the BJP not pressuring the Prime Minister, LG and the ACB to investigate and arrest the real accused, their friends in the Congress?
The double standards of PM Narendra Modi ji to save corrupt members of the Congress Party and arrest honest anti-corruption crusaders of the Aam Aadmi Party is clear to this nation. While I do ask him the questions above, I have just a few lines to say to PM Modi ji:
