  • Memorandums submitted to hon’ble President of India

Please find attached the text of two memorandums submitted to the hon’ble President of India Mr Pranab Mukherjee by a delegation led by the Delhi Chief Minister Mr Arvind Kejriwal, Deputy Chief Minister Mr Manish Sisodia, Social Welfare Minister Mr Sandeep Kumar, Vidhan Sabha Deputy Speaker Ms Rakhi Bidlan along with 10 MLAs of the Delhi assembly.

Subjects of the two memorandums are as follows :

1) Certain unlawful proceedings conducted by the Hon’ble Lt. Governor of Delhi under defunct/non-existent laws to allegedly favour a fair price shop owner, overruling the decision of the elected Delhi government.
2) Unprovoked assault on a Dalit councillor of North MCD Shri Rakesh Kumar by BJP activists in full public and media glare at a time when he was participating in the proceedings of the MCDs as a legitimately elected Member of the MCD at the Ramlila Ground on Thursday.

Respected Rashtrapati ji,

The country as a whole is suffocating due to repressive measures perpetrated by the elements inimical to the social harmony in the society. Such forces gaining support of the State machinery in their cynical activities, it appears now, is not a co-incidence. Any keen watcher of the developments in the country would easily understand that the attacks on dalits, minorities, women and all the oppressed sections of the society are not happening in isolation but in a co-ordinated and synchronized manner with ulterior motives.
What prompted us, Sir, to present this appeal to you is an incident that happened at Ram Lila Maidan, New Delhi yesterday (09 June 2016). Shri Rakesh Kumar, a Dalit Councilr of North MCD went there to attend the joint meeting of all three MCDs. Without any provocation, some Councilors and activists belonging to BJP brutally assaulted him in full public and media glare at a time when he was participating in the proceedings of the MCDs as a legitimately elected Member of the MCD.
Aam Admi Party has very few representatives in the current structure of MCDs and its Dalit Councilor was an easy prey for the BJP which has majority in MCDs. It is worth recalling that in the Legislative Assembly of N.C.T. of Delhi too, inspite of being in overwhelming majority, the AAP is at the receiving end of abuses and disruptions by the Members of BJP. One of the BJP Members does not hesitate to use abusive and derogatory words against a fellow woman Member belonging to AAP in full House. The same Member was seen on television by the entire nation, beating up a political activist belonging to minority community, on a road adjacent to Patiala House Courts in New Delhi.
Though such attacks by BJP leaders against dalits, minorities and women have become very common, hardly any one is brought to book. As a result, there is an increase of such attacks, day in and day out, as there is no fear of law among the criminals in the society who have got political patronage from the BJP.
Another disturbing factor is that the top officer of Delhi Police who selectively harassed the MLAS and activists of AAP and who accorded royal hospitality to the BJP legislator in a police station when he was arrested briefly for attacking a political activist, is rewarded with a constitutional position. This clearly is a dangerous message being given by the Govt. of India to the State machinery that “be with us in all our misdeeds and get suitably rewarded.”
The Legislative Assembly of N.C.T. of Delhi in its meeting held on 9 June 2016, adopted a motion strongly condemning the attack on Shri Rakesh Kumar and directed the Commissioner of Delhi Police to arrest the perpetrators of violence and proceed against them under provisions of SC/ST Act, IPC and all other applicable laws.

Sir, in the light of these developments, we request you to step-in as the custodian of the Constitution to issue necessary directions to all concerned to take corrective steps so that the faith of dalits, women, minorities and weaker sections of the society is restored in the State machinery which is expected to function within the parameters prescribed under the Constitution of India.
