Delhi Water Minister Kapil Mishra on Tuesday (28th June) issued the following statement on the ACB Notice for the Tanker Scam during the Sheila Dikshit government’s tenure :
We are about to witness a world record that the Centre’s BJP-led Government has achieved. I have studied national and international legal precedents and I am confident that this is the first time in world history that individuals exposing corruption and a financial scam are being investigated instead of the malicious perpetrators of corruption. The illogicality of this decision is incomprehensible.
I thought it would be a good idea to speak to my friends in the media and the citizens of Delhi before my arrest is orchestrated which is something that many reliable sources have confirmed. Our party’s elected representatives have been roughed up and arrested at press conferences as well, so I hope I get the time to speak to you and keep my thoughts in entirety.
As Chairperson of the Delhi Jal Board (DJB), I constituted a committee to investigate the tanker scam conducted under Congress CM Sheila Dikshit. Joint Director (F&A) of the DJB, JC Atal, was appointed the Head of the committee as Chairman with four other Members.
The fact-finding committee showed that this was a case of serious bungling with the criminal conspiracy in connivance of all concerned authorities, board, members, companies and consultant. Due to their scandalous activity and fraud, DJB has lost about Rs. 400 crores of public money whereas common people received no benefit.
I sent this report on 28th August 2015 first to the Chief Minister of Delhi, Shri Arvind Kejriwal ji, even while expecting de-stabilizing forces to rattle our government for exposing corruption of the Congress.
Prime Minister Mr Narendra Modi had already sent paramilitary forces on 8th June 2015 to take over the Anti-Corruption Bureau to ensure that former Congress CM Sheila Dikshit and the Lieutenant Governor Najeeb Jung’s role in several scams were not exposed. Occupying the Anti-Corruption Bureau on Central Government orders was the illegally appointed MK Meena who was implicated in scams related to curtain procurement amongst many others to execute the farce of the Central Government.
Further, in what can only be termed open encouragement of corruption, the Central Government brought 2 notifications on 22nd July 2014 and 21st May 2015, to explicitly remove the Central Government and its organisations outside the ambit of the Delhi Anti-Corruption Bureau, when they saw exemplary action taken by the CM Arvind Kejriwal against corruption. These draconian notifications have been widely panned by legal and constitutional experts for infringing the federal structure of the constitution and protecting corrupt individuals within Delhi. The constitutionality of the MHA notification is currently being fought in the courts and the Delhi Government is committed to bringing corrupt criminals in politics to justice.
Given this background, our Chief Minister Arvind Kejriwal ji was apprehensive that the LG operating through the illegal ACB Chief would misuse our expose against former CM Sheila Dikshit financially and politically.
This is exactly what happened after the takeover of the ACB, after which all investigations against the Congress, Sheila Dikshit ji and Najeeb Jung ji have been stalled. Our government which has provided a 125 page report as evidence against former CM Sheila Dikshit is being interrogated instead of the perpetrators of corruption and crime. I have been summoned by the ACB on 4th July 2016for being an honest minister working to expose financial impropriety instead of the former CM Sheila Dikshit, her cabinet colleagues, her MLAs or her officers. I would like to remind the Hon’ble LG of a few lines even as he sets to execute the wishes of his political masters:
तुम लाख चाहे आफत में मेरी जान रखना,
मगर अपने वास्ते भी कुछ इम्तिहान रखना
38 cases sent by the Vigilance Department of the Delhi Government to the ACB have been thrown into the dustbin by the BJP’s Central government and hon’ble LG using the ACB as a caged parrot.
No progress has been seen in 3 FIRs filed by the first AAP Government against former CM Sheila Dikshit or her colleagues in the last 2.5 years.
No action has been taken in the Commonwealth Games Streetlight scam, in which an FIR was lodged in February 2014 by the first AAP Government.
The Hon’ble LG has not taken action on evidence, FIRs or any of the 50,000 complaints that his office has received so far during his tenure. However, he has taken action on a single page plain paper complaint with no evidence filed by BJP’s Vijender Gupta and filed for action against our government. The Lieutenant Governor, who despite being a neutral Constitutional position has taken sides, and has directed the illegal ACB Chief to issue an FIR against our government for unearthing a scam and demanding action on corruption done under the tenure of the Congress CM Sheila Dikshit.
The BJP, which is known for dramatic, malicious and false rhetoric, attempted to put the ball in the Delhi Government’s court for not having taken action against former CM Sheila Dikshit. In response, I sent this fact-finding report of this committee to PM Narendra Modi and hon’ble Lieutenant Governor Najeeb Jung with an immediate request to file an FIR and arrest former CM Sheila Dikshit based on its findings. Their inaction, doublespeak and malafide intentions have been completely exposed them in the eyes of the public.
PM Mr Narendra Modi’s attempt to shield the corruption of former CM Sheila Dikshit via the Lieutenant Governor and the illegal ACB Chief confirms the doubt that CM Arvind Kejriwal ji harboured. That the BJP and Congress are one party in reality who will protect each others’ corruption. And PM Narendra Modi has shown that yet another promise of his was a jumla.
However, I welcome their decision. Under the leadership of the Aam Aadmi’s CM Arvind Kejriwal ji, I will continue to accept such love letters in the guise of notices, FIRs or future arrests. I will expose the corruption of the establishment whether it is BJP, Congress or anyone else. The Aam Aadmi’s benefit is my main motive and it is from them that I derive my power.
In 2008, I had protested against former CM Sheila Dikshit’s corruption as a common citizen inside the Delhi Legislative Assembly and was beaten up and arrested for speaking the truth. As a representative of the Aam Aadmi, I have and will continue to expose corruption no matter where it exists.
In closing, I would like to remind PM Modi ji, of a few lines written by former BJP PM Atal Behari Vajpayee ji:
जो बरसों तक सड़े जेल में, उनकी याद करें।
जो फाँसी पर चढ़े खेल में, उनकी याद करें।
बलिदानों की बेला आई,
लोकतंत्र दे रहा दुहाई,
स्वाभिमान से वही जियेगा
जिससे कीमत गई चुकाई
