The Directorate of Education, in view of the largescale violations of various provisions of the Delhi School Education Act, 1973 and rules made there under and the provisions of the Right to Education Act, 2009 and non compliance of its orders, the Directorate has directed managing committee/manager of the Maxfort School, Pitam Pura and Maxfort School Rohini, to show cause in writing as to why the power under section 20 of the Delhi School Education Act, 1973 for taking over their management should not be exercised for the aforesaid said violations.
These schools have been asked to furnish their replies within 15 days on receipt of this notice, failing which appropriate action under section 20 of the Delhi School Education Act, 1973 shall be taken by the Directorate without any further notice to the managing
committee/ manager.

BRIEF DETAILS OF THE ISSUE ARE AS FOLLOWS :

Ø Maxfort School Parents Association, Rohini and Pitampura, Delhi filed a complaint dated 24/11/2015 alleging the various irregularities and violations of DSEAR, 1973 made by Maxfort Schools running at Pitam Pura and Rohini on the following issues:-
(i) Land Scam,
(ii) Formation of fake trusts/societies for receiving capitation fee against admissions,
(iii) Money laundering financial irregularities and Bank Account Manipulation,
(iv) Tax Evasion through manipulation of accounts with the help of Auditors and Directorate of Education,
(v) Incomplete, fake, forged records regarding EWS Admissions submitted by school management to Directorate of Education regularly. No physical verification of data done by Directorate of Education,
(vi) Regular and repeated harassment of children and parents,


Ø On the aforesaid complaint, Deputy Chief Minister and Education Minister Mr manish Sisodia on 02/12/2015 directed District Magistrate (District North-West) to enquire into the allegations leveled by the said parents association against the said schools.

Ø A committee was also set up by Directorate of Education vide order dated 21.12.2015 to enquire into the allegations of violations and malpractices in admission of EWS/DG category students and other allegations as made by Parents Association of Maxfort Schools relating to payment of salaries to the teachers in violation of the DSEAR, 1973.

Ø The said committee constituted by the Directorate of Education inspected the school on 21.12.2015 and 22.12.2015 to verify the records of students of EWS/DG category who were granted admission in the schools since 2011-12 onwards and to find out whether the teachers recruited in the schools are in accordance with Recruitment Rules of the Department and salaries being paid to them as per sixth pay commissions’ recommendations or not.



Ø The said committee in its report dated 07/01/2016 indicated that the school authorities did not co-operate with the Committee and found the following irregularities in the functioning of the school at Rohini:-

(i) That the school failed to provide admission record of EWS/DG category for the period prior to 2014-15.

(ii) That there are violations of the provisions of RTE Act, 09 in the admissions under EWS /DG category for the year 2014-15 and 2015-16 since the number of such seats filled were far below than the 25% of the total strength of the class.

(iii) That the school has furnished false information to the Directorate in respect of the actual admission made in 2015-16 under the General Category.

(iv) That the school has increased the enrolment/intake of students of general category in the session 2015-16 but has not admitted EWS/DG category students against these fresh admissions.

(v) That the school has failed to maintain the service books and personal files of teachers. There were 40 teachers who were regular and 63 teachers were found to have been appointed on contractual basis. Therefore, about 2/3rd of the teachers strength has been found on the roll of the school on contract basis and the names of these contractual staff have not been reflected in the staff statement to the Department prior to 2014-15 under Rule 180(1).

(vi) The school failed to furnish the details relating to salary statements of the staffs, attendance registers of the staff and other relevant documents as required by the Committee.

Ø The said committee in its report dated 07/01/2016 indicated that the school authorities did not co-operate with the Committee and found the following irregularities in the functioning of the school at Pitam Pura:-

i. That the school failed to provide admission record of EWS/DG category upto the satisfaction of the inspection teams.

ii. That there are violations of the provisions of RTE Act, 09 in the admissions under EWS /DG category for the year 2015-16 since the number of such seats filled were far below than the 25% of the total strength of the class.

iii. That the school has increased the enrolment/intake of students of general category in the session 2015-16 but has not admitted EWS/DG category students against these fresh admissions.

iv. That the school has failed to maintain the service books and personal files of teachers and more than ½ of the teachers were found to have been appointed on contractual basis.

v. The school failed to furnish the details relating to salary statements of the staffs, attendance registers of the staff and other relevant documents as required by the Committee.

Ø As per above report of enrolment of EWS/DG students, the trend of declining the enrolment of EWS/DG category students in subsequent classes indicates that the schools were involved in gross malpractices in EWS/DG admissions and also failed to facilitate continuation of studies of EWS/DG Category students in violation of the provisions of RTE Act, 09.

Ø The schools have failed to provide complete record relating to the payment of salaries etc to the staff and teachers and the possibilities of allegation made regarding non-payment of arrears of Sixth Pay Commissions Recommendations to the teachers despite collection of fee from the parents/students can’t be ruled out.

Ø The Inquiry Report furnished by the District Magistrate (North-West) on 08.01.2016 also pointed out various irregularities and violations by the schools in respect of the provisions of Delhi School Education Act and Rules, 1973 and Right to Education Act, 09 and other directions of the department as under:-

(i) That the directions may be issued to DDA at appropriate level for taking strict action against violation of lease condition.

(ii) That regarding formation of fake trust/society, the matter may be referred to Registrar of Societies to enquire as to whether the societies running various Maxfort schools are as per norms or not.

(iii) That economic offence wing of Delhi Police being specific investigating agency may register a case and conduct the inquiry especially with regard to tax evasion/money laundering by the society running the schools.

(iv) That despite giving adequate opportunities, the schools did not bother to file any explanation reply against the allegations and the school has taken huge amount of capitation fees/donation from the parents at the time of admissions and are not refunding the same even after clear direction of Hon’ble High Court of Delhi as well as Directorate of Education.

(v) In respect of other allegation relating to irregularities in EWS admission, arrears being not paid to the teachers, the District Magistrate (North-West) has supported the inquiry report submitted by the Committee constituted by the Directorate of Education.

Ø in the aforesaid facts and circumstances as surfaced in the report of the District Magistrate (NW) and the Committee constituted by the Directorate of Education, it was clearly established that the management of Maxfort Schools at Pitam Pura and Rohini, Delhi are deliberately violating the section 10 and section 24 of Delhi School Education Act, 1973 read with Rules 190, 50 170, 173, 175 of DSEAR, 1973 and section 12(1)(c) of the Right to Education Act, 2009 as under:-

(a) The school has collected capitation fee /donations from the parents while admitting their wards in the school in violation of provisions of Delhi School Education Act and Rules 1973 and various judgment in this regard and despite directions issued by the Department for refund of such illegal collection of capitation fee/donations vide order dated 16.04.2015 and 08.09.2015, the school has failed to comply those directions.

(b) The school has failed to co-operate with the Committees constituted by the Government and the Directorate and refused to allow inspection and furnish such reports and information to the committee which were required to be examined regarding the compliance of the provisions of the DSEAR, 1973 and Right to Education Act 2009 and Rules 2011 in clear violation of the provisions of the Rule 50 of DSEAR, 1973.

(c) The school has failed to comply with the provisions of the Right to Education Act, 09 relating to admissions to EWS/DG category and facilitating continuation of education of admitted students in this category in violation of the provisions section 12(1)(C) of the said Act .
(d) The school has failed to maintain statutory records of the school fund and the service records of the teachers and other staffs in violation of the section 10 of the Delhi School Education Act and Rules, 1973.

(e) The school has failed to appoint sufficient regular teachers.

Ø The reports of District Magistrate and the Committee constituted by the Directorate clearly indicate that the management of the schools in collusion with Manager and Principal, have violated section 24 of Delhi School Education Act, 1973 read with the Rule 190 of DSEAR, 1973 and other mandatory provisions and did not cooperate with the enquiry committee and failed to furnish documents relating to account of Fee and contributions being not available in the school in accordance with the Government Rules.

Ø Simultaneously, as recommended by the District Magistrate (NW), letters have been written to DDA, Registrar or Societies, Economic Offence Wing of Delhi Police to inquire the allegations in accordance with their rules and take action as per law against these schools.

Ø In view of the aforesaid violations of various provisions of Delhi School Education Act, 1973 and rules made thereunder and the provisions of the Right to Education Act, 2009 and non compliance of the order of the Directorate as mentioned above, the managing committee/manager of the Maxfort Schools at Pitam Pura and Rohini, Delhi have been directed to show cause in writing within 15 days as to why the power under section 20 of Delhi School Education Act, 1973 should not be exercised for the said violations vide Show Causes Notices to each school.

- मैक्सफोर्ट स्कूल्स की दोनों ब्रांच्स में ईडब्ल्यूएस/डीजी एडमिशन में धांधली, वित्तीय अनियमितता, टीचर्स का फर्जी रिकॉर्ड रखने के मामले सामने आए हैं
प्राइवेट स्कूलों की मनमानी रोकने के लिए दिल्ली सरकार ने सोमवार को एक कड़ा फैसला लेते हुए मैक्सफोर्ट स्कूल्स की दो ब्रांच्स रोहिणी और पीतमपुरा को टेकओवर करने के लिए शो कॉज नोटिस जारी कर दिया। पैरेंट्स और टीचर्स से मिली शिकायतों की जांच के बाद ये फैसला लिया गया है। दिल्ली के उप-मुख्यमंत्री और शिक्षा मंत्री मनीष सिसोदिया ने ट्वीट करके इस फैसले की जानकारी दी।
दोनों ब्रांच्स में ईडब्ल्यूएस/डीजी एडमिशन में धांधली, वित्तीय अनियमितता और टीचर्स का फर्जी रिकॉर्ड रखने के मामले सामने आए हैं।
मैक्सफोर्ट, रोहिणी और पीतमपुरा की जांच में पाया गया :
1- दोनों ब्रांच 2014-15 से पहले किए गए ईडब्ल्यूएस/डीजी एडमिशन के रिकॉर्ड नहीं दे पाये।
2- दोनों ब्रांच में आरटीई एक्ट, 09 के प्रावधानों का भी उल्लंघन किया गया है। मैक्सफोर्ट, रोहिणी ने 2014-15 और 2015-16 में और मैक्सफोर्ट, पीतमपुरा ने 2015-16 में ईडब्ल्यूएस/डीजी कैटिगरी की सीटों पर 25 फीसदी से काफी कम एडमिशन दिया है।
3- मैक्सफोर्ट, रोहिणी ने 2015-16 में जनरल कैटिगरी के तहत किए गए वास्तविक दाखिलों की गलत जानकारी शिक्षा निदेशालय को दी।
4- दोनों ब्रांच ने 2015-16 के लिए जनरल कैटिगरी की सीटों में इजाफा किया लेकिन उसके अनुपात में ईडब्ल्यूएस/डीजी कैटिगरी को एडमिशन नहीं दिया।
5- दोनों ब्रांच ने टीचर्स की पर्सनल फाइल्स और सर्विस बुक्स मेनटेन नहीं किया। दोनों ब्रांच ने कॉन्ट्रैक्चुअल टीचर्स रखने की निर्धारित संख्या का पालन नहीं किया।
6- दोनों ब्रांच ने अपने स्टॉफ्स की सैलरी स्टेटमेंट्स, अटेंडेंस रजिस्टर और अन्य जरूरी डाक्युमेंट्स उपलब्ध नहीं करा पाये।
इन सबके अलावा मैक्सफोर्ट स्कूल ने पैरेंट्स के उनके बच्चों के एडमिशन के लिए कैपिटेशन फी/डोनेशन लिया जो कि डेल्ही स्कूल एजुकेशन एक्ट एंड रूल्स 1973 के प्रावधानों का उल्लंघन है। मैक्सफोर्ट स्कूल, अपने स्कूल फंड का भी रिकॉर्ड नहीं दे पाया है।
यही नहीं, शिक्षा विभाग द्वारा पैरेंट्स को कैपिटेशन फी/डोनेशन वापस करने संबंधी निर्देशों का भी पालन नहीं किया गया। सरकार और शिक्षा निदेशालय ने इन शिकायतों की जांच के लिए जो कमेटीज बनाईं, उनको भी जांच में सहयोग नहीं किया गया।

इन्हें देखते हुए दिल्ली सरकार ने डेल्ही स्कूल एजुकेशन एक्ट, 1973 के सेक्शन 20 का इस्तेमाल करते हुए मैक्सफोर्ट स्कूल, रोहिणी और पीतमपुरा को टेकओवर करने का शो कॉज नोटिस जारी किया गया है। दोनों ब्रांच को 15 दिन के भीतर नोटिस का लिखित जवाब देना है।
